Distinguishing Features of the Class

The Supervising Hearing Examiner oversees and presides over hearings for the adjudication of parking violation charges. This position supervises the work of the bureau and manages all legal matters pertaining to its operations. Incumbents work independently, preparing judgments and executions, and exercise supervision over part-time Hearing Examiners and parking enforcement personnel. Immediate supervision is received from the Commissioner of Parking. The duties and qualifications for this position are established in the New York State Vehicle and Traffic Law, Article 2-B, Section 236.

Typical Work Activities

  • Presides over hearings for parking violations, scofflaws, and other related cases.

  • Supervises and schedules per diem Hearing Examiners.

  • Proposes updates and amendments to the Hearing Examiner manual for review by the Commissioner of Parking.

  • Interacts with the public and their representatives regarding hearings.

  • Oversees ex-parte hearings, hearings by mail, out-of-town hearings, fleet owners’ hearings, and other special cases.

  • Schedules and manages appeals.

  • Assists in the development of bureau policies and programs.

  • Prepares judgments and executions.

  • Supervises the Revenue Recovery Program.

  • Serves as a member of the Appeals Board.

  • Performs related duties as required.

Knowledge, Skills, Abilities, and Personal Characteristics

  • Thorough knowledge of municipal law in New York State.

  • Thorough knowledge of New York State Vehicle and Traffic Law.

  • Skilled in preparing legal memoranda, conducting legal research, and analyzing legal issues.

  • Ability to organize factual and legal data into clear, logical sequences.

  • Ability to interpret laws, rules, and regulations.

  • Strong oral and written communication skills.

  • Ability to establish and maintain effective working relationships.

  • Physical condition commensurate with the demands of the position.

Minimum Qualifications

  • Admission to practice law in New York State for at least seven (7) years.

  • Documentation verifying eligibility must be presented at the time of application.
